(b) the property is situated within the Rural 1 or 2 Zone of the Marlborough Sounds Resource Management Plan and the dogs are kept solely or principally for herding stock and the number of dogs is reasonably necessary for that purpose; or (c) the property is situated within the Rural 3 or 4 Zone of the Wairau/Awatere Resource Management Plan and the dogs are kept solely or principally for herding stock and the number of dogs is reasonably necessary for that purpose. 406.2 An application for a Licence must: (a) Be in writing in and in general accordance with the form required by Council; and (b) Include any additional information reasonably required by Council to process the application; and (c) Include payment of the application fee, prescribed by Council from time to time, at the time of lodging the application. 406.3 An application for a Licence will be considered by the Council in its absolute discretion, taking into account: (a) The location and size of the property on which dogs will be kept; (b) Containment and housing of the dogs, and the distance of that housing from the property boundary and neighbouring houses; (c) The method of removing and disposing of dog faeces, liquid waste and wash down water; (d) The availability of adequate supervision and exercise for the dogs; (e) Any previous history of non-compliance with the Dog Control Act 1996 and/or Bylaws; (f) Any other factors considered relevant by the Council. 406.4 The Council may impose any reasonable conditions under a Licence that are consistent with the objects of the Dog Control Act 1996 or this Bylaw. 406.5 Unless otherwise stated in the Licence, the Licence Holder must comply with any conditions imposed by the Council within one month of the grant of the Licence. 406.6 Council may enter the property at any reasonable time to inspect the property when assessing an application for a Licence, for compliance with these Bylaws, the Licence and any conditions imposed under the Licence. 406.8 Failure to comply with the conditions of a Licence within the specified time will invalidate that Licence. 406.9 If Council determines that the keeping of the additional dog(s) is inconsistent with the provisions of the Dog Control Act 1996 or this Bylaw, Council may impose additional conditions under, or revoke, any Licence by giving one month’s notice in writing to the Licence Holder. 406.10 On revocation of the Licence, the Licence Holder must, within 14 days of the date of Council’s notice of revocation reduce the number of dogs kept on the property to the number specified by Council. 406.11 Nothing in bylaw 406 applies: (a) To any premises used as a registered veterinary clinic; or (b) To any premises used lawfully for the purpose of a commercial boarding kennel; or Page 3
