(c) To any premises used for the purpose of impounding dogs under the Dog Control Act 1996; or (d) To any premises where animals are kept under the care of the Society of Prevention of Cruelty to Animals. 407 Standards for Keeping Dogs 407.1 Dog owners must ensure that their dog(s) is provided with: (a) Clean and hygienic accommodation that provides shade, shelter, dry, adequate ventilation and draft-free conditions, such that the dog is kept an appropriate temperature; and (b) Adequate food, water, care and attention; and (c) Adequate exercise; and (d) Appropriate veterinarian care. 407.2 Dog owners must ensure that dog accommodation is: (a) located and designed to minimize nuisance and/or risk to humans and other animals; and (b) at least two metres from a boundary fence. 407.3 If the Council has reasonable grounds to believe that a dog is being kept in contravention of Bylaw 407, the Council may, by written notice, require the owner to take such action as is necessary to ensure compliance within a specified timeframe. Should the owner not comply with that notice, the Council may issue infringement notices. 408 Dogs in or on Vehicles 408.1 Any person who allows or leaves a dog in a public place inside or on a vehicle must take all reasonable steps to ensure that the dog: (a) is unable to escape that vehicle; (b) does not present a risk or cause distress or nuisance to members of the public; and (c) has adequate ventilation, water and shelter to ensure the dog is comfortable and is not at risk of overheating or dehydration. 408.2 When on a vehicle in a public place, dogs must be secured in a manner that prevents the dog from jumping or falling from that vehicle. 409 Neutering of Dogs 409.1 Where any owner fails to keep his or her dog under control on repeated occasions, the Council may, by written notice, require the owner to cause that dog to be neutered. The owner must, within one month after receipt of the notice, produce to the Council a certificate issued by a veterinarian certifying: (a) that the dog is or has been neutered; or (b) that for reasons that are specified in the certificate, the dog will not be in a fit condition to be neutered before a date specified in the certificate.
