Chapter 29 - Urban Residential Zone 29.1.1.3.4 Sunlight and Privacy for Neighbours - All Activities No part of any building shall exceed a height equal to the recession plane angle determined by the application of Figures 25.2 and 25.3 of the Definitions Chapter. To determine the maximum permitted height in relation to boundaries on the lot the diagram in Figure 25.2 (Recession Plane Indicator) must be viewed within the lot, and orientated north. The angle of inclination relative to a particular boundary is determined by the angle on the diagram in Figure 25.3 adjacent to that boundary. Except as provided elsewhere in the Plan, where a lot boundary abuts the street or road, no part of any building should exceed a height limit imposed by a line drawn at an angle of 55° from the horizontal and originating and drawn at right angles from a point 2.0 metres above the boundary of the lot where it abuts the street or road. Exception 29.1.1.3.4.1 Subject to lodging with the Council written approval from the owners of property bounding the garage being constructed a garage for the housing of motor vehicles may be sited on a side or rear boundary provided that: a) The continuous length of a building sited on the boundary may not exceed 9.0 metres; b) The exemption can be applied to only one side boundary and one rear boundary; c) Any such building shall be sited at least 5.5 metres from the front boundary; d) The maximum height of the building at the boundary does not exceed 3.0 metres; and 29.1.1.3.4.2 Unless specified in the schedule of water bodies and Table 1 in Appendix I and the Ecology Maps in Volume Three or to the contrary elsewhere in the Plan, all proposed buildings and structures shall be set back at least 8 metres from the top of any bank of any river, or where there is a stopbank at least 8 metres from the landward toe of that stopbank, except that this shall not apply to culverts and bridges. Buildings and structures shall be set back at least 20 metres from the coast, lakes and wetlands. 29.1.1.3.5 Siting Requirements for Garages A front yard of 5.5 metres shall be provided for a garage having vehicular access directly from the road or street. 29.1.2 Noise All permitted activities shall be conducted so as to ensure that noise arising from such activities does not exceed the following noise limits at or within the boundary of any other site zoned Urban Residential: 0700 hours - 2200 hours Monday to Friday and 55 dBA L10 0700 hours - 1200 hours Saturday On any day between 0700 hours - 2200 hours No L max limit At all other times including any public holiday 45 dBA L10 and 70 dBA L max 29 - 3
